TERMS & CONDITIONS

Payment. Invoice with payment instructions will be sent upon confirmation of order. Payment is due upon receipt of invoice.

Title and Ownership. Title to and ownership of Wine will pass from Direct du Domaine to you in France upon full payment of the purchase price plus any applicable taxes that we may be obligated to collect at the time of purchase. Wine is deemed delivered to you in France. Direct du Domaine does not ship Wine to any location, including the United States. Please see “Storage” and “Fulfillment of Wine” below for additional information.

Storage. Wines you purchase will be automatically placed into storage in a climate-controlled environment in an account under your name at Hillebrand Gori’s facility located at 11 rue Louis et Gaston Chevrolet, 21200 Beaune, France (the “Hillebrand Facility”). Twelve months of complimentary storage of your Wines at the Hillebrand Facility is included in the purchase price. After this time, an additional storage fee will be assessed at a rate of 1€ per case per month + insurance (.04% declared value per month) and will be billed to you by Direct du Domaine.

Insurance. Wines that are owned by you and stored at the Hillebrand Facility will be insured at their assessed value, which is determined monthly in Direct du Domaine’s sole discretion. Any additional coverage will be your responsibility to obtain. Please contact us if you would like additional information regarding insurance coverage at the Hillebrand Facility.

Fulfillment of Wine. Upon receipt of payment, Direct du Domaine will consolidate your wines with other clients’ purchases and release them for shipping by Cote d’Or Imports, an independent shipping and logistics company. Cote d’Or Imports will contact you once they have taken possession of the wines to organize shipment via ocean or air freight.

Note that any applicable fulfillment and handling costs are not included in the Wine’s purchase price and will be billed directly to you by Cote d’Or Imports and are governed by their Terms and Conditions.

If you wish to make independent arrangements for fulfillment, Wines may be picked up directly from the Hillebrand Facility with 7 days notice. VAT and other local taxes may apply. Any duties and/or taxes due in this scenario will be the sole responsibility of the client. Direct du Domaine is not responsible for providing an accurate estimate of these charges.

Representations and Warranties. Direct du Domaine makes no representation as to the legal rights of anyone to ship or import any wines, alcoholic beverages, or other goods into the U.S. or into any state or jurisdiction inside the U.S. You are solely responsible for the fulfillment of Wine purchased, and for determining the legality and the tax/duty consequences of having the wine and other goods shipped to the applicable destination. You agree to indemnify, defend and hold Direct du Domaine harmless from and against any and all claims, liabilities, and expenses (including taxes, interest, penalties, and attorney fees and amounts paid in an investigation, defending or settling any of the foregoing) arising out of or in connection with: (1) any act by or omission by you, your agents or employees, or allegations made upon such acts or omissions, relating to or affecting the Wine sold to you by Direct du Domaine in accordance with these Terms and Conditions, (2) any inaccuracy of any representation made by you in connection with the transactions contemplated by these Terms and Conditions; and (3) any claims brought or asserted by any third party against Customer for any wine sold by Direct du Domaine to the Customer and shipped in accordance with the Customer's instructions and per these Terms and Conditions.
